Home Education is governed by provisions set out in the Education Act 2016 and the Education Regulations 2017. You can find the Education Act here and the Education Regulations here
The Education Regulations set out Standards which clearly state what is to be contained in an approved home education program. These Standards are contained in Schedule 1 of the Regulations. The regulations have been reproduced on this site in the Home Education Summary and Program – Requirements and Standards document below.
In addition to this legislative framework, Ministerial Instructions have been approved by the Minister for Education and Training. Ministerial Instruction 13 is the home education Instruction. These Instructions provide guidance in the interpretation and application of the legislation.
